Our Responsibilities
In accordance with the Digital Millennium Copyright Act of 1998 (DMCA) and specifically 17 USC § 512(c)(3), Ardenel will respond expeditiously to claims of copyright infringement reported to our Designated Copyright Agent identified below.
DMCA Notice of Alleged Infringement
To file a notice, please provide our Designated Copyright Agent with the following information:
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
- Identification of the material or link you claim is infringing, including the specific URL or exact location on the Site.
- Contact Information: Your mailing address, telephone number, and email address.
- Good Faith Statement: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement: A statement that the information in the notice is accurate, and under penalty of perjury, that you are the owner or authorized to act on behalf of the owner.
- Signature: Your full legal name and your electronic or physical signature.
DMCA Counter-Notice
If you believe your content was removed by mistake or misidentification, you may send a Counter-Notice including the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and its location before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or applicable international jurisdiction).
Repeat Infringer Policy
Ardenel does not tolerate copyright infringement. We reserve the right to terminate the access privileges of any user determined to be a repeat infringer — generally defined as any user for whom Ardenel has received two or more valid DMCA Notices of Alleged Infringement.
*Ardenel reserves the right to define the criteria for repeat infringers and will adopt statutory definitions as a minimum standard where applicable under 17 USC § 512. This policy is subject to change without prior notice.
